Limited Boat Trailer Warranty

This warranty is given to the original boat dealer for the consumer only. This warranty shall be effective for a period of 24 months from the date of purchase by the consumer or 36 months from the date of manufacture, whichever comes first. The warranty provided herein is in lieu of all other express warranties and any implied warranties, including any implied warranties of merchantability or fitness or intended use which are limited in duration to the period defined above. The consumer must notify Tidewater Trailers at 1 Newbold Rd.  Fairless Hills, PA 19030 (on the card provided by the dealer at time of purchase) within 30 days of purchase. Failure to comply with this notification within the time period, will relieve Tidewater Trailers from any responsibility under this warranty.

During the period of the warranty Tidewater Trailers warrants the following parts to be free from defects in material and workmanship, when used under normal conditions for the manufactured (and designed) purpose, and provided they receive proper care: winch stand assembly, tongue assembly, frame assembly, roller and roller bracket assemblies.

The following items are warranted by other manufacturers and are therefore not included in this warranty: winch, coupling, lights, brakes, tires, wheels, axles, springs, rope, cable, dolly jack and hub assemblies.

Tidewater Trailers upon notification and prior authorization will repair or replace at its option, any part covered under this warranty and found to be defective by them.

It is the responsibility of the purchaser to complete the registration form provided at the time of purchase and return it to Tidewater Trailers. It is also the responsibility of the purchaser to read, understand, and follow the instructions in the "Owners Manual" supplied with the trailer and to obtain a packet from the dealer of Tidewater Trailers if none was supplied. In addition, the purchaser must return the trailer to an Authorized Tidewater Trailer dealer for any warranty work. No transportation charge or other related expenses (such as but not limited to, loss of time, towing charges, travel expenses, and the like) will be paid by Tidewater Trailers. The purchaser is also required to contact a Tidewater Trailer dealer within 15 days after discovery, and said dealer will handle any corrective action required under this warranty after prior written authorization from Tidewater Trailers. If there is no dealer within the practical vicinity, the owner must contact Tidewater Trailers directly to obtain prior written authorization for any corrective action required under this warranty.

Exclusions

This warranty specifically does not apply to:

1. Damage caused by abuse, negligence, (including improperly tightened wheel lug bolts or nuts, or improperly adjusted trailer coupling), vandalism, lack of maintenance, corrosion, improper storage, accidents, overloading, or unauthorized repairs.

2. Any statements, representations or warranties given by dealers or other third persons other than those as provided herein.

3. Any additional damage incurred after the owner s failure to notify Tidewater Trailers of a defect within 15 days after discovery.

4. Any unit which is part of a rental fleet.

5. Consequential damages including without limitations (but not personal injury): loss of time, inconvenience, towing charges, expenses for travel, lodging, telephone charges, loss or damage to
personal property or loss of revenues.

6. Any and all damages caused to the manufacturer's, dealer's, or consumer's boat or personal property on or attached to the boat from any cause except trailer failure.

7. Any altered or modified trailer.

Use of any Tidewater Trailer for commercial applications make this warranty null and void.

This warranty complies with the "Magnusson-Moss Warranty Federal Trade Commission Improvement Act," limited warranty provisions and any provisions of the warranty or actions taken by Tidewater Trailers, pursuant to this warranty shall be construed accordingly.
